Market Data Lite Service Level Terms
These Service Level Terms (the “SLA”) set forth Pave’s obligations and our customers’ rights with respect to the performance of the Pave application Market Data Lite (“Market Data Lite”). All capitalized terms used but not otherwise defined in this SLA have the meanings given to them in the Master Subscription Agreement (the “MSA”) between you (the “Customer”) and Trove Information Technologies, Inc. dba Pave (“Pave”).

1. Service Availability
Customer acknowledges that Market Data Lite is a free Pave product, and is provided on an "as-is" and "as-available" basis without any service level commitments. Pave makes no guarantees regarding uptime, availability, performance, or reliability of Market Data Lite.
2. No Warranty
MARKET DATA LITE IS PROVIDED WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. PAVE DOES NOT WARRANT THAT MARKET DATA LITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.
3. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PAVE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO MARKET DATA LITE, REGARDLESS OF THE THEORY OF LIABILITY, EVEN IF PAVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
PAVE'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THE FREE TIER SHALL NOT EXCEED FIFTY DOLLARS ($50.00).
4. No Remedies
Customer acknowledges and agrees that no service credits, refunds, or other remedies are available for any service interruptions, degradations, or failures related to Market Data Lite. Customer's sole remedy for dissatisfaction with Market Data Lite is to discontinue use.
5. Support Terms & Exclusion
Customer may initiate a support ticket any time at https://support.pave.com/hc/en-us.
Pave will use commercially reasonable efforts to provide a first response to all support tickets within two (2) business day of ticket creation during standard support hours.
Pave has no obligation to provide technical support, maintenance, updates, or assistance for Market Data Lite. Any support provided is at Pave's sole discretion and may be discontinued at any time.
6. Right to Modify or Discontinue
Pave reserves the right to modify, suspend, or discontinue Market Data Lite at any time, with or without notice, for any reason or no reason, without liability to Customer.
